If the last time you renewed a work permit was a couple of years ago, the advice you remember is now wrong, and acting on it could cost you your job. The safety net that used to cover people whose renewal was still pending has been taken away. Here is what actually applies now, and when you need to file. The rule that changed, and why it matters

For years, filing a renewal on time bought you protection. If your Employment Authorization Document expired while USCIS was still working through your application, an automatic extension kept you working, latterly for as much as 540 days.

That ended. Under an interim final rule effective 30 October 2025, most people who file an EAD renewal on or after that date get no automatic extension at all. USCIS puts it plainly: the majority of those who filed on or after 30 October 2025 are not eligible to receive an automatic extension.

If you filed before 30 October 2025 and you qualified, your extension still stands. Everyone renewing now is in the new world.

What that means in practice is simple and harsh. Your right to work now ends on the date printed on your card, whether or not USCIS has finished with your renewal. There is no grace period to fall back on.

When to file: earlier than you think

USCIS accepts a renewal Form I-765 up to 180 days before your current EAD expires. That window used to be a convenience. It is now the whole strategy.

The old habit was to file somewhere near the expiry date and let the automatic extension absorb the wait. With no extension, every week you delay is a week that may land on the wrong side of your expiry date. File at the earliest moment USCIS will accept it — day 180.

What renewal costs

The fee depends on how you file and whether you have a green card application pending. These are the USCIS fees as of September 2026.

Filing online saves $50 and gives you a trackable receipt straight away, which matters more than the money when a deadline is involved. How to file, step by step

  1. Find your category code. It is printed on the front of your current EAD, in the form C08, C09, A05 and so on. Everything else depends on it.
  2. Check you are still eligible in that category. A renewal is not automatic; the underlying reason you could work has to still hold.
  3. Work out your earliest filing date — 180 days before the expiry printed on the card.
  4. File Form I-765 online through a USCIS account. It is cheaper and faster to confirm than paper.
  5. Pay the right fee from the table above.
  6. Include the supporting documents your category requires, plus a copy of your current card.
  7. Save the receipt notice, Form I-797C, the moment it arrives, and check that the category code on it matches the one on your card.
  8. Track the case and respond to any request for evidence immediately. An RFE left sitting is the most common way a renewal misses an expiry date.

What happens if your card expires while you wait

This is the part people underestimate. Without an automatic extension, on the day after your EAD expires you are no longer authorised to work, even with a pending renewal and a receipt notice in hand.

Your employer is not being difficult when they act on this. They are required to reverify your work authorisation on Form I-9, and if you cannot show valid authorisation they cannot lawfully keep you employed. People lose jobs this way with an approved renewal arriving weeks later.

There are narrow exceptions. Some extensions are granted separately by law or by a Federal Register notice rather than by the general rule, and certain programmes have their own arrangements. Temporary Protected Status is the clearest case: TPS-based authorisation in categories A12 and C19 is now limited to the shorter of one year or the duration of TPS, for filings on or after 22 July 2025. If you are in one of these situations, confirm your own position rather than assuming either way.

Mistakes that cost people their authorisation

  • Filing at 30 days instead of 180. The single most expensive habit, and the one the old rule used to forgive.
  • Assuming the receipt notice lets you keep working. It does not, unless an extension actually applies to you.
  • A category mismatch between your card and your receipt notice, which used to break automatic extensions and still signals a problem worth resolving.
  • Paying the wrong fee and having the filing rejected, which returns you to the back of the queue with weeks lost.
  • Letting an RFE sit because the deadline on it looks generous. It is not, relative to your card.
  • Assuming a green card application protects you. A pending I-485 changes your fee, not your right to work. Only the green card itself removes the need for an EAD, because permanent residents may work for any employer without one.

The verdict

Work permit renewal used to be a piece of admin with a safety net under it. It is now a deadline with nothing underneath, and the only real protection left is time.

So treat the 180-day mark as the filing date rather than the earliest option. Diary it the week you receive a new card, because that is the one moment you are certain to be thinking about it. Everything else — the fee, the documents, the category code — is straightforward once you are not fighting the calendar.
